1. Acceptance of Terms & Ownership

Ownership: The GuestPark website, mobile application and all associated digital services (the "Service") are owned and operated by GuestPark Inc. All intellectual property rights are reserved.

Agreement: By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you are entering into this agreement on behalf of a company or legal entity (such as a condominium corporation or property management firm), you represent and warrant that you possess the legal authority to bind that entity to these terms.

2. Service Description

GuestPark provides a digital platform designed to manage and facilitate visitor parking requests within residential condominiums. The Service acts as a communication tool between visitors, residents, and concierge or security staff. GuestPark Inc. does not own, manage, or maintain the physical parking facilities.

3. Fees and Payments

  • Billing: Subscription services are billed in advance on a monthly basis.
  • Taxes: All fees are exclusive of applicable Canadian taxes (GST/HST/PST). These will be calculated and added to your invoice based on your province of operation.
  • Late Payments: We reserve the right to suspend or terminate Service access if an account remains unpaid for more than 15 days past the invoice due date.

4. User Responsibilities

Users of the Service agree to:

  • Provide and maintain accurate, current, and complete information (including license plate data and contact details).
  • Use the Service strictly for its intended purpose of parking management.
  • Maintain the confidentiality of account credentials.
  • Comply with all applicable municipal bylaws and condominium rules.
  • Refrain from any attempt to circumvent, hack, or gain unauthorized access to the system.

5. Parking Requests & Approval

Submission of a parking request via the Service does not guarantee a parking authorization. All requests are subject to the specific bylaws of the condominium and the approval of residents or management. GuestPark Inc. is not responsible for denied requests, nor for any towing, fines, or citations resulting from a user's failure to secure a valid permit or follow on-site signage.

6. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GuestPark Inc. makes no warranties regarding system uptime, data accuracy, or reliability. We are not liable for:

  • Any direct, indirect, or consequential damages arising from the use of the Service.
  • Physical damage, theft, or vandalism to vehicles parked on-site.
  • Disputes between residents, visitors, and building management.

7. Service Modifications & Termination

GuestPark Inc. reserves the right to modify, suspend, or terminate access to the Service at our sole discretion, without notice, for violations of these terms or for any conduct we deem harmful to the Service or other users.

8. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal actions or disputes shall be resolved exclusively within the courts of Ontario.
